The EB2 National Interest Waiver is designed for professionals who are poised to make a meaningful and lasting impact on the United States. Where the EB1A recognizes what you have already achieved, the EB- NIW looks forward — rewarding those whose vision, expertise, and planned contributions are set to benefit the country in significant ways. Like the EB1A, the EB2 NIW allows you to self-petition, giving you the freedom to pursue your green card on your own terms — without waiting for an employer to open a door that was always yours to walk through.
EB2 NIW National Interest Waiver Criteria
To qualify for the EB-2 National Interest Waiver, an applicant must first meet the standard EB-2 requirement of holding an advanced degree or demonstrating exceptional ability in their field. Beyond that baseline, USCIS applies the three-prong test established in Matter of Dhanasar to determine whether a waiver of the job offer and labor certification requirement is warranted.
